Terms of service

1. Agreement

By creating an account or using PCNTrack ("the Service"), you agree to these Terms of Service ("Terms") in full. If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you ("Customer") and the operator of PCNTrack.

2. Free trial

PCNTrack offers a 14-day free trial on all plans. During the trial:

• You have full access to all features available on your selected plan.
• No payment is taken during the trial period.
• If you do not cancel before the trial ends, your subscription will begin and your payment method will be charged the monthly fee for your selected plan.
• If you cancel before the trial ends, your access will continue until the trial expiry date and you will not be charged.
• We reserve the right to end or modify the free trial offer at any time for new sign-ups. Existing trials will be honoured for their full 14-day period.

3. Subscription and payment

Subscriptions are billed monthly in advance. All prices are in GBP and exclude VAT where applicable. Payment is processed securely by Stripe. We do not store your card details.

If a payment fails, we will attempt to collect payment again after 3 days and 7 days. After two failed attempts, your account will be suspended until payment is resolved. You will be notified by email at each stage.

You may cancel your subscription at any time through the billing portal in Settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except where required by law.

4. Access and subscription enforcement

Access to PCNTrack is conditional on maintaining an active subscription or an active free trial.

• When your trial or subscription ends, your access to the dashboard, PCN processing, and driver notifications will be immediately suspended.
• Your data is retained securely for 90 days after subscription cancellation. You can export your data or reactivate your subscription at any time within this window.
• After 90 days, data may be permanently deleted in accordance with our Privacy Policy.
• We will send reminder emails at 7 days, 3 days, and 1 day before your trial or subscription expires.

5. Acceptable use

You agree to use PCNTrack only for lawful fleet compliance purposes. You must not:

• Upload PCNs or data relating to vehicles or individuals you are not authorised to manage
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Use the Service to send unsolicited messages to drivers
• Share your account credentials with third parties
• Use the Service in a way that violates UK data protection law

6. Data processing

By using PCNTrack, you acknowledge that:

• You are the data controller for your drivers' personal data. PCNTrack acts as your data processor.
• Our Data Processing Agreement (DPA), available at /dpa, is incorporated into these Terms and forms part of our agreement with you.
• You are responsible for ensuring you have a lawful basis to share your drivers' personal data with us and to send them notifications via PCNTrack.
• All SMS messages sent via PCNTrack include opt-out instructions as required by Ofcom guidelines.

7. Service availability and features

We aim for 99.5% monthly uptime. Some features listed on the pricing page are marked as "Coming soon" — these are planned features not yet available. You will not be charged specifically for coming-soon features, and their expected availability is not guaranteed. We will provide reasonable advance notice if a planned feature is cancelled.

PCNTrack processes PCN photographs using AI and cannot guarantee 100% extraction accuracy. You are responsible for verifying extracted data before taking action on any PCN.

8. Limitation of liability

PCNTrack is a tool to assist with PCN management. We are not a legal service. Nothing in this Service constitutes legal advice. We are not liable for:

• PCN escalations or late payment penalties arising from missed or failed notifications
• Errors in AI-extracted PCN data that you did not verify before acting on
• Any loss arising from service downtime within our stated SLA

Our total liability to you in any 12-month period is limited to the total fees you paid to us in that period.

9. Changes to these terms

We will give you at least 30 days' notice by email before any material change to these Terms takes effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms. If you do not accept the new Terms, you may cancel your subscription before the effective date.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
